Former FBI Worker Claims Improper Termination Because of LGBTQ+ Symbol Presence
A long-serving Federal Bureau of Investigation operative has filed a legal case stating his let go on account of displaying a Pride flag within his desk area.
Based on David Maltinsky, that was employed with the bureau for 16 years, the firing recently was “unconstitutional and politically motivated”.
Court Case Alleges Constitutional Infringements
The complaint states that the bureau infringed upon Maltinsky’s constitutional freedoms and engaged in punitive steps toward him due to engaging in constitutionally covered communication.
The former specialist is seeking a judicial directive to reinstate his job with the FBI.
Details of the Lawsuit
The comprehensive filing, filed in the US district court for the District of Columbia, states that the plaintiff was terminated from the FBI academy last month over earlier exhibiting the flag in his workspace.
According to the document, the LGBTQ+ banner was presented to the plaintiff to honor his efforts to advance the agency’s inclusion programs.
Since childhood, my goal was to serve the nation and safeguard the nation’s safety alongside the talented and committed personnel in the bureau,” said the plaintiff.
He added, I exhibited that Pride flag – which in 2021 was raised before the Los Angeles office – not for political reasons, but as a symbol of diversity, togetherness and fair treatment.
“These are the values that previously strengthened the FBI strong. Currently it stands as where individuals such as myself are targeted. I am convinced I was dismissed not on account of my identity, but rather because of what I represent: a proud gay man,” he said.
Abrupt Termination Just ahead of Finish
In the past months, Maltinsky was accepted into the federal agent training program at the FBI facility, until what he described as “unexpected firing shortly before finishing”.
The filing also claims that later after Donald Trump’s inauguration, an colleague reported a complaint to the overseeing official regarding the presence of the LGBTQ+ symbol.
As a precaution, the employee asked that the Chief Division Counsel for the local bureau examine if the display of the Progress Pride flag was acceptable,” the document stated.
It added, The advisor advised the plaintiff that exhibiting of the symbol was not against the agency’s standards.”
Notification of Dismissal
Despite this, on the first of October, the employee was informed of his termination.
In correspondence cited in the complaint, agency head the official commented, I have concluded that you demonstrated bad decision-making by exhibiting of political signage at your workstation in your prior role at the Los Angeles Field Office.
In accordance with Article II of the U.S. Constitution, and regulations of the United States, your employment at the bureau is now ended.”
Lawyer Remarks
In a release released on Wednesday, his legal representative Kerrie Riggs said, “This administration’s unlawfully firing him is part of a larger campaign to remove public offices of employees with divergent opinions, or represent underrepresented communities, or who dare speak out against prejudice.
His case goes beyond his situation, but also about ensuring the entitlements and freedoms of all federal employees.”
Bureau Response
The bureau did not provide a statement on the lawsuit.
